Are my chats used to train the AI?

Facts as of October 10, 2026 · checked for Claude

With Claude, you decide that yourself – even on a paid plan. Since a change to its terms in August 2025, the provider asks users on the Free, Pro and Max plans whether their conversations may be used for training. The statement “If you pay, you're not used for training” isn't accurate as it stands.

In detail

If you agree, your conversations are stored for five years; if you decline, it stays at thirty days. Training is contractually excluded for accounts for businesses, government agencies and educational institutions, as well as for the API.

The data is processed in the US or in other countries outside the European Economic Area. For users in the EEA, Anthropic Ireland Limited is responsible; the transfer is safeguarded through adequacy decisions and standard contractual clauses.

The safest thing is to check the setting in your own account instead of relying on an assumption. For teams, a second question comes up: Can I put other people's data into a personal AI subscription?

In practice

Thomas J. Weiss had himself assumed that paying customers aren't used for training. A fact check before a talk in October 2026 proved otherwise: two of his four answers on data protection didn't hold up. He has been working with the system for quite a while – and still, in two places, his knowledge of the rules was not what currently applies.
