Can I put other people's data into a personal AI subscription?

Facts as of October 10, 2026

With a personal subscription, better not. If you have a service process other people's data, you usually need a data processing agreement for it. With Claude, that's only available for team and business accounts. Data from counseling, health care or HR work therefore doesn't belong in a personal account.

In detail

No agreement in a personal account. Anthropic offers a data processing agreement with EU standard contractual clauses as an addendum to its commercial terms for businesses; personal accounts aren't covered by it. So if you process other people's data with a personal account, you have no such agreement – and insofar as this legally counts as processing on someone's behalf, you lack the paperwork the GDPR requires for it.

Leaving out names often isn't enough. In 2024 the Data Protection Conference of the German federal and state authorities stated: if the context makes a person identifiable, deleting the name is not enough. Religion and health call for extra caution.

Some organizations have their own rules. Churches in Germany, for example, in some cases have their own data protection laws with their own supervisory authorities. Clarify what applies to you with your organization or its data protection officer – before data goes into a model.

Options with data kept in the EU: Langdock, based in Berlin, offers access to several models hosted in the EU, for €25 net per person per month – without the work on your own computer. Through the cloud platforms of Amazon and Google, Claude is available with data kept in the EU, but as a business offering that is hard to reach without an IT department. Only a local model avoids data leaving your hands entirely.

This is an assessment, not legal advice.

In practice

Thomas J. Weiss summed it up while preparing a talk:

In the end, it has to be secure.
